OFFICIAL RULES
THESE ARE THE OFFICIAL RULES OF THE SWEEPSTAKES DESCRIBED IN THE CORRELATING POST (THE “POST”).
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THE FOLLOWING PRINCESS CRUISES VALENTINES SWEEPSTAKES (“SWEEPSTAKES”) IS GOVERNED BY THESE OFFICIAL RULES. THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. BY PARTICIPATING IN THE SWEEPSTAKES, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS STATED HEREIN, AND IN THE POST. Void where prohibited.
Eligibility: The Sweepstakes is open to all legal residents of the 50 United States who have reached 21 years of age or older as of January 17, 2014 and who have a valid email address and Facebook account. All employees, contractors, directors, and officers of Sponsor, its advertising and promotion agencies, Facebook, and each of their respective parent companies, divisions, affiliates, subsidiaries, or agents (collectively, “Sweepstakes Entities”) and their immediate families (defined as spouse, child, sibling, parent, or grandparent) or household members are not eligible. Sponsor reserves the right to verify eligibility qualifications of Winner. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sweepstakes is subject to all applicable federal, state and local laws.
Promotion Period: The Sweepstakes begins on January 17, 2014 at 9:00:00 am Pacific Standard Time (“PST”) and ends on January 22, 2014 at 11:59:59 pm PST (the “Promotion Period”). All entries must be received by January 22, 2014 at 11:59:59 pm PST.
How To Enter: During the Promotion Period, eligible entrants (“Entrants”) can receive one (1) entry into the Sweepstakes (“Entrants”) by accessing the Princess Cruises Facebook Page at www.facebook.com/princesscruises (the “Website”) and submitting one (1) comment in English on the January 17, 2014 post about why you deserve a Valentine’s Day getaway (“Entry”)) (subject to verification with the Entry Requirements set forth below). There is a limit on the number of Entries as provided in the Post. There is a limit of one (1) Entry per Facebook account/person/email address for the entire Promotion Period. Sponsor will not accept cancellation once submitted. In order to be able to enter the Sweepstakes, Potential Entrants must first “Like” the Princess Cruises Facebook Page. All Entries must have a valid Facebook account that will accept inbound messages. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. Any questions, comments or complaints regarding this Sweepstakes shall be directed to Sponsor and not to Facebook. Please see the privacy policy located at http://www.princess.com/legal/legal_privacy/index.jsp for details of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes.
Automated entries are prohibited and any such use will cause disqualification. Entrants may not enter with multiple email addresses/Facebook accounts nor may entrants use any other device or artifice to enter multiple times or as multiple entrants. If it is discovered that you have entered or attempted to enter the Sweepstakes more than once or have attempted to enter multiple times using multiple identities, Facebook accounts or email addresses, or that you submitted or attempted to submit more than the Entry limit provided above, all of your Entries will be declared null and void, and any prize you might have been entitled to will not be awarded. Each Entry will be subject to Facebook’s Terms of Use (found at www.facebook.com), and must comply with the Entry requirements set forth in more detail below. Presence of an Entry on the Website is not a confirmation, representation or warranty by the Sponsor or any of its representatives that the Entry is compliant with these Rules. Sponsor’s decisions with respect to whether an Entry complies with these Official Rules are final and binding and may be made by Sponsor at any time. Entries that do not meet the requirements set forth in these Official Rules may not be acknowledged and may be automatically disqualified, in the sole discretion of the Sponsor and/or Facebook. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or Website or by any technical or human error which may occur in the processing of the entries. If a dispute arises regarding who submitted an Entry, the Entry will be deemed to be submitted by the authorized account holder of the Facebook account/email address provided at time of entry and he/she must comply with these Official Rules and the Post. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
Winner acknowledges and agrees that submission of an Entry grants Sponsor and its agents a worldwide, perpetual, non-exclusive license and right to publish, use, edit and adapt the Entry in any way, in any and all media, without consideration to the Entrant, except where prohibited by law. Further, to the extent Entrant may have moral rights in the Entry submitted, he/she hereby waives all such moral rights in favor of Sponsor.
The comment submitted as your Entry must comply with all requirements set forth herein, including the entry requirements provided below to be considered an eligible Sweepstakes Entry.
By submitting an Entry, entrants agree to indemnify and hold Sweepstakes Entities harmless from and against any and all claims, demands, actions, causes of action, damages, costs or expenses brought against or suffered or incurred by the Sweepstakes Entities, or any of them, arising out of or in connection with the participation by the entrants in this Sweepstakes, any breach by the entrants of the foregoing warranties or agreements or the use, in whole or in part, by any Sweepstakes Entity of any Entry (or portion thereof) submitted by the entrants in this Sweepstakes. By participating, entrants agree to these Official Rules, which are final and binding in all respects.
By submitting an Entry in the Sweepstakes, you hereby warrant and represent that your Entry conforms to the Entry Requirements set forth herein. Entries:
• cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
• cannot promote alcohol, illegal drugs, tobacco, firearms/weapons, or gambling (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
• cannot be obscene or offensive, defamatory, libelous, threatening, harassing, or endorse any form of hate or hate group;
• cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies;
• other than Sponsor trademark and brand, cannot contain trademarks or logos owned by others, or advertise or promote any brand or product of any kind;
• cannot contain materials that infringe on any individual’s intellectual property rights, portrait rights, or right of publicity (unless you have express permission from that person to use their likeness and performance in connection with this Sweepstakes), or disgrace or discredit by harassment or defamation, discrimination, or detriment to others
• cannot infringe on any trademarks, logos, copyrighted works, trade dress (such as distinctive packaging or building exteriors/interiors) or any intellectual property owned by others (including but not limited to music, photographs, sculptures, paintings and other works of art or images, published on or in websites, television, movies or other media); Sponsor does not permit the infringement of others’ rights and any use of materials not original to the entrant (except copyrighted materials owned by Sponsor) is grounds for disqualification from the Sweepstakes. Do not copy your favorite movie, book or photo or include materials, images, graphics, music or trademarks belonging to any third parties or incorporate the names, voices, likeness or personas of any party other than yourself unless you have obtained all rights necessary to permit you to use same in connection with your Entry and grant the rights herein granted to Sponsor; The Entry cannot (in the sole discretion of Sponsor) advertise or promote any brand or product of any kind other than the Sponsor’s, including, but not limited to, any of Sponsor’s competitors, any of Sweepstakes Entities’ competitors, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses without permission;
• cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
• cannot suggest intention of promotion, sales, election, soliciting for specific philosophy or religion
• cannot depict, and cannot itself, be in violation of any law; and
• cannot contain any other content that is or could be considered inappropriate, unsuitable, or offensive, as determined by Sponsor in its sole discretion.
Sponsor reserves the right to waive the Sweepstakes entry requirements set forth herein in its reasonable discretion. Sponsor reserves the right, in its reasonable discretion, during or upon completion of the Promotion Period, to request that any Entrant resubmit his or her Entry which fails to comply with the Sweepstakes entry requirements prior to the drawing date.
By submitting an Entry, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you.
Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual, non-exclusive license and right to publish, use, publicly perform, adapt, edit, and/or modify the Entry in any way, in any and all media, without limitation, and without consideration to the entrant. By submitting an Entry, the entrant consents to the Sponsor and its agents doing (or omitting to do) any acts which may otherwise constitute an infringement of the entrant’s moral rights.
BY SUBMITTING AN ENTRY YOU WARRANT AND REPRESENT TO THE SWEEPSTAKES ENTITIES THAT YOUR ENTRY DOES NOT INFRINGE UPON THE COPYRIGHTS, TRADEMARKS RIGHTS, RIGHTS OF PRIVACY, PUBLICITY, MORAL OR OTHER INTELLECTUAL PROPERTY RIGHTS OR OTHER RIGHTS OF ANY PERSON OR ENTITY, AND THAT PUBLICATION OF THE ENTRY VIA VARIOUS MEDIA INCLUDING WEB POSTING, WILL NOT INFRINGE ON THE RIGHTS OF ANY THIRD PARTY RIGHTS. Any entrant whose Entry includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such Entry, in a form satisfactory to Sponsor, upon request, prior to award of prize and/or naming of entrant as a potential winner.

ENTRIES POSTED TO THE WEBSITE WERE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. Sponsor reserves the right to, and may or may not, monitor/screen Entries. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit. You acknowledge that, by acceptance of your Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. By submitting an Entry you warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; and (e) and that posting of the Entry via various media including Web posting, will not infringe on the rights of any third party. Any such entrant will indemnify and hold harmless, Sponsor, Facebook, Inc., and Sweepstakes Entities from any claims to the contrary.
By accepting a prize, the Winner agrees that his/her Entry will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then the winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Entry, including all but not limited to all copyright and trademark rights which he or she may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Winner hereby waives in favor of Sponsor, all rights of “Droit Moral” or “Moral Rights of Authors” or any similar rights or principles of law that Winner may now or later have to their Entry. Sponsor reserves the right to alter, change or modify the winning Entry, in its sole discretion. Upon request of Sponsor, Winner shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry and of the copyrights transferred and “Moral Rights of Authors” waived/consented to under these Official Rules. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the assignment.
Winner Selection: On or about January 23, 2014, Sponsor will randomly select one-hundred twenty (120) Sweepstakes winners in a random drawing from among all eligible Entries. Odds of winning a prize depend on the number of eligible entries received during the Promotion Period. Sponsor reserves the right to choose all Winners of the Sweepstakes.
The Winners will be notified by Facebook via a comment on their Entry on or about January 23, 2014. Winner is subject to verification, including verification of age. Winner may also be required to complete, sign and return an Affidavit/Declaration of Eligibility/Liability Release, and, where lawful, a Publicity Release within five (5) days of attempted notification or prize may be forfeited. If winner is found to be ineligible, or not in compliance with these Official Rules and/or the Post, declines to accept a prize, if Sponsor is unable to contact the winner within five (5) business days of attempting contact, or in the event that a prize notification is returned undeliverable, the prize may be forfeited. Sweepstakes Entities shall not be held responsible for any change of email address or other contact information of entrants, or for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to verified winners.
Prize (120): One-hundred twenty (120) verified Grand Prize winners (“Winner(s)”) will receive one (1) cruise for the winner and one (1) guest on the Ruby Princess 5-day Western Caribbean cruise departing from Ft. Lauderdale and cruising February 10, 2014 to February 15, 2014 (“Cruise”), sharing accommodations of one (1) Balcony Stateroom (”Grand Prize” ).
TRANSPORTATION TO AND FROM THE POINT OF EMBARKMENT/DISEMBARKMENT IS NOT INCLUDED. All prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion.
Each Grand Prize Cruise includes a balcony stateroom with double occupancy accommodations for up to two (2) persons and all regular onboard meals and entertainment.
Cruise may only be used on the Ruby Princess voyage departing February 10, 2014. Any difference between stated and actual value will not be awarded. All applicable government fees and taxes for cruise, gratuities, air transportation, ground transportation, shore excursions fees, discretionary hotel and dining charges, meals in alternate dining venues, alcoholic beverages, boutique purchases, and any other incidental costs or other expenses not specifically set forth herein are the sole responsibility of Winners. All reservations and cruise arrangements including, without limitation, the dates, times, and airline choice are at the sole discretion of Sponsor. All Cruises must be taken from February 10-15, 2014; no alternative cruise dates are available. In the event any winner cannot cruise during dates specified by Sponsor, such winner will forfeit his/her Grand Prize. All prize reservations, cruise arrangements, and prize details are at the sole discretion of the Sponsor and are subject to availability, restrictions may apply. Cruise guests must be 21 years of age or older as of the date of departure. Winners and cruise guests must cruise on same itinerary. Each cruise guest must sign and return a cruise/publicity release before any ticketing of cruise occurs. The Winners and cruise guests must have all necessary identification and/or cruise documents (including but not limited to a valid passport, visa (if applicable) and all other necessary travel documents) required for Cruise. Once cruise guest is selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Cruise is subject to the terms and conditions of the Princess passage contract.
As set forth in more detail in the passage contract, Princess reserves the right to refuse to embark Winner or Cruise Guest, at any time if, in the sole opinion of Princess, Winner or Cruise Guest, or any minor or other person in Winner or Cruise Guest’s care during the cruise, are unfit for any reason for the Cruise. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by Cruise operators or any other persons providing any Grand Prize-related services or accommodations. Grand Prize Winner and Cruise Guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged Cruise tickets, travel vouchers or certificates will not be replaced or exchanged. Unclaimed prizes will not be awarded.
Average Retail Value Of each grand prize: Up to $1,168.00. Actual value of trip may vary. Any difference between stated approximate retail value and actual value of prize will not be awarded. Total ARV of all Sweepstakes’ prizes: Up to $140,160.
General Conditions: Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize will be awarded only to an address within the United States. Winner will be solely responsible for all applicable taxes connected with receipt of prize, the use and enjoyment of prize, or any other connection with this Sweepstakes unless otherwise required by law or unless this requirement is waived by the Sponsor in its sole discretion. As a condition of accepting the prize, Winner agrees to furnish any requested information needed for tax reporting. By participating in this Sweepstakes, Entrants understand and agree (and agree to confirm in writing): (a) to abide to these Official Rules which are final and binding and the decisions of Sponsor with respect to all aspects of the Sweepstakes, which are final, (b) to accept the prize as awarded, with substitution, and to release and hold harmless Sponsor, its parent, subsidiary and affiliated companies, advertising and promoting agencies, any other party associated with the development or administration of this Sweepstakes, Facebook, and all of their respective officers, directors, employees, representatives and agents (collectively, “Releasees”) from and against any and all liability whatsoever, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damages, loss or destruction of property rights of publicity or privacy, defamation, or portrayal in a false light) in connection with this Sweepstakes or with the announcement, acceptance, ownership, or use or misuse of prize (including but not limited to any travel related thereto) and/or use of the Entry, or other errors in these terms and conditions and (c) except where legally prohibited, by accepting the prize, each Winner agrees to the use of his/her name, photograph, likeness, address (city and state of residence), voice, image and biographical information and statements by Sponsor and those acting under Sponsor’s authority for advertising, trade, publicity and promotional purposes without additional compensation, in perpetuity, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval. Releasees are not responsible for loss, damage, or claims resulting from the Sweepstakes. Participants or Winner will be disqualified for any attempt to tamper with any aspect of the Sweepstakes, or circumvent these Official Rules. Sponsor reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Sponsor that is fair and equitable to Sweepstakes participants. Sponsor reserves the right, in its sole discretion, to void, modify, terminate or suspend this Sweepstakes (or any portion thereof) should fraud or any unauthorized human intervention or other causes beyond the reasonable control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. BY ACCEPTING PRIZE, WINNER ACCEPTS (AGREES TO CONFIRM IN WRITING) THE INHERENTLY DANGEROUS NATURE AND RISK IN SEA TRAVEL, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT RELEASEES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH. If any provision of the Official Rules or the application of any such provision to any person or circumstance shall be declared to be invalid, unenforceable or void, such decision shall not have the effect of invalidating or voiding the remainder of the Official Rules, it being the intent and agreement of the parties that the Official Rules shall be deemed amended by modifying such provision to the extent necessary to render it valid, legal and enforceable while preserving its intent or, if such modification is not possible, by substituting therefore another provision that is valid, legal and enforceable so as to give effect to Sponsor’s intent.
If and to the extent that law applies to this Promotion, or to any dispute arising in connection with this Promotion, nothing in these Official Rules shall in any way limit or exclude liability for or in connection with (a) fraud, or (b) death or personal injury caused by negligence.
Sponsor reserves the right to disqualify any entrant’s registration in the Sweepstakes (and void all associated Entries) or entitlement to a prize, if, in the sole discretion of the Sponsor, it determines or suspects that the entrant has attempted to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process).
Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Sweepstakes at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes corrupt the administration, security, integrity or proper play of the Sweepstakes. In the event of cancellation, Sponsor reserves the right to select the winners from among all eligible, non-suspect entries received up to time of such cancellation. In no event will the Sponsor be liable for more than the stated number of prizes available in the prize category in question.
Sweepstakes Entities do not warrant that access to the Sweepstakes will be uninterrupted. Sweepstakes Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Sweepstakes; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in connection with the administration of the Sweepstakes, the processing of entries, the offering or announcement of any prize or in any prize notification documents; or (d) for any other errors of any kind relating to or in connection with the Sweepstakes, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Sweepstakes; or (f) damage to a user's computer system occasioned by participation in this Sweepstakes or downloading any information necessary to participate in this Sweepstakes.
Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Sweepstakes, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrant engaging in any of the foregoing activities may be disqualified (and all associated entries will be void) and will forfeit any prize won.
Disputes: As a condition of participating, participants agree (and agree to confirm in writing), to the extent permitted by law: (a) to release Releasees from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California. By entering, participants consent to the jurisdiction and venue of the federal, state and local courts located in Los Angeles County, California.
